Terms of service.

These terms govern your use of BuildSite. By connecting a wallet or publishing a site you accept them. If you do not accept them, do not use the service.

1. What the service is

BuildSite is a self-service tool that generates a self-contained HTML page from a template and the content you supply, uploads that page to IPFS through Pinata, and helps you write the resulting contenthash to an ENS name you control.

It is a tool, not a hosting provider, not a domain registrar and not a custodian. We never hold your ENS name, your funds or your keys. Every state change is a transaction you sign yourself.

2. Eligibility

• You must be at least 18 and legally able to enter into a contract.
• You must not be a person or entity subject to sanctions, or located in a jurisdiction subject to comprehensive sanctions.
• You must control the wallet you connect, and control or be authorised to manage the ENS name you publish to.

3. Fees

Publishing a site charges a one-time platform fee, shown in the wizard before you sign and quoted in ETH. The fee covers permanent Pinata IPFS storage of your page and the platform infrastructure that generated it.

• ENS registration costs and Ethereum gas are separate, paid at cost to the network and the registrar, and are never received by us.
• The platform fee is not refundable. A blockchain payment cannot be reversed by us, and the storage it pays for is committed as soon as the page is pinned.
• Fees may change. The price shown at the moment you sign is the price that applies to that publish.
• A failed or reverted transaction may still cost gas. That is a property of Ethereum, not a charge by us.

4. Your content

You keep all rights in the content you supply. You grant us only the permission technically required to do what you asked: to render it into an HTML page and to upload and pin that page to IPFS.

You are solely responsible for what you publish, and you warrant that it:

• is yours to publish, or is used with permission, including all images;
• does not infringe anyone’s intellectual property, privacy or publicity rights;
• is not unlawful, fraudulent, deceptive, defamatory, malicious, or designed to impersonate another person or organisation;
• does not solicit funds or credentials under false pretences, and does not distribute malware.

We do not review content before it is published, and we have no practical means of removing it afterwards. That is a consequence of the architecture, not a policy position — see clause 6.

5. The templates

The template designs and the BuildSite application are ours or our licensors’. The HTML page generated for you is yours to keep, host, modify and re-publish anywhere, with no attribution required and no lock-in. You may not resell the BuildSite service itself or present it as your own.

6. Permanence, and what we cannot undo

Publishing writes to systems that no one can retract. Once your page is pinned to IPFS it may be copied and re-pinned by anyone; once your contenthash is written to Ethereum the transaction is permanent. We cannot delete a published site, edit it, un-publish it, or reverse a payment. You can point your ENS name elsewhere or clear the record from your own wallet, but the previously published content may remain reachable indefinitely.

7. Availability

The service is provided as-is and may be modified, interrupted or discontinued at any time without notice. We depend on Ethereum, ENS, IPFS, Pinata, RPC providers and wallet infrastructure, none of which we control. Sites that have already been published are unaffected by our availability — that is the point of publishing them this way.

8. Acceptable use

• Do not use the service to publish anything prohibited under clause 4.
• Do not attempt to interfere with, overload or circumvent the fee mechanism or any rate limit.
• Do not use the service to publish a page that imitates a real person or organisation in a way intended to deceive.

We may decline service to any address at our discretion. We cannot take down what has already been published.

9. Disclaimers and liability

The service is provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. See the disclaimer for the risks in full.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, data, tokens or names. Our total aggregate liability arising out of or relating to the service is limited to the platform fees you actually paid us in the twelve months preceding the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence.

10. Indemnity

You will indemnify us against claims, losses and reasonable legal costs arising from content you published, from your breach of these terms, or from your infringement of a third party’s rights.

11. Changes to these terms

We may revise these terms. The date at the top of this page is the version in force, and continuing to use the service after a change means you accept the revised terms. A change never applies retroactively to a site you already published.

12. Governing law and severability

These terms are governed by the laws of the Dominican Republic, without regard to conflict-of-law rules, and the courts of the Dominican Republic have exclusive jurisdiction — except where mandatory consumer-protection law in your country of residence grants you a different forum. If any clause is held unenforceable, the rest remains in force.
